1. Description of Service
We provide a digital waste tracking platform designed to assist companies in logging, tracking, and reporting digital waste in compliance with UK regulations. Features include, but are not limited to:
- Digital Waste Tracking (DWT) Log submissions and receipt history storage.
- The Intelligear tracking system, digital Address Books, and Simple Reports.
- In-app team communication tools (Live Chat) and client helpdesk systems (Live Support).
2. Account Registration & User Management
2.1 Account Creation
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep this information updated.
2.2 User Roles and Account Responsibility
Administrators within your organization have the ability to manage users, assign roles, and set access permissions.
- You are responsible for safeguarding your login credentials.
- You accept full responsibility for all activities that occur under your account or the accounts of users you manage.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Acceptable Use & Conduct
You agree to use the Service only for lawful business purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable UK laws or regulations (including statutory digital waste reporting mandates).
- Misuse the Live Chat feature to transmit defamatory, harassing, or inappropriate messages to team members or support staff.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, our servers, or databases.
- Use any automated system (such as robots, spiders, or scrapers) to extract data from the Service without our express written permission.
4. Data Syncing and Offline Mode
The mobile application offers an Offline Mode to allow data logging without an active internet connection.
- Data entered in Offline Mode is stored locally on your device.
- We are not liable for any data loss occurring on your local device before a successful synchronization with our cloud servers takes place.
- It is the user’s responsibility to bring the device back online to ensure proper data syncing and compliance logging before regulatory deadlines.
5. Intellectual Property Rights
The Service, including its original content, features, functionality (including the Intelligear logic and layout), and user interface design are and will remain the exclusive property of IntelliGear and its licensors.
Our trademarks, logos, and proprietary system names may not be used in connection with any product or service without our prior written consent.
6. Disclaimers & Limitation of Liability
6.1 Regulatory Disclaimer
While our Service is built around the UK digital waste law frameworks to provide tracking tools and “Simple Reports,” the final responsibility for legal compliance lies solely with your company. We do not guarantee that the use of our app guarantees automatic legal certification or immunity from regulatory audits.
6.2 Service Availability
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be completely uninterrupted, timely, secure, or error-free.
6.3 Limitation of Liability
To the maximum extent permitted by law, IntelliGear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or regulatory fines resulting from your use of, or inability to use, the Service.
7. Suspension and Termination
We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms, fail to pay subscription fees, or use the Service in a manner that poses security or legal risks to us or other users.
Upon termination, your right to use the Service will cease immediately. If you wish to export your DWT Receipts or history upon account closure, you must request this prior to termination, subject to our standard data retention policy.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
